General: When an order is placed it indicates the acceptance of the terms and conditions stated below. We reserve the right to change the terms and conditions at anytime.
Aquatic Ponds Price Match: We are very competitive with our prices. However, if on another website you find a product that is lower then ours we will do our best to beat the price. We will need the name of the web site, product (must not be an outdated model), pricing with shipping charges. Product must be in stock and ready to ship. We do not match clearance items, rebates, promotions and free with purchase offers. All prices on pond supply matching must be done before sale is completed. Please keep in mind most of our items already include shipping unless otherwise noted and will match up with competitor’s price plus shipping charges and taxes if in PA. Price Match does not include looking into view carts or scrolling over for prices. Competitor’s price must be listed (printed) on web page.
Credit towards Items: If you have received a credit, you will need to be registered to be able to receive the credit. All credits must be used within 90 days. Shipping charges will apply when applicable.
Payments: We accept all Major Credit Cards, Paypal and Money Orders. When sending a money order you must include shipping address (please print), email address (for tracking #), phone number, item description, cost of product and shipping costs. Checks are not accepted.
Shipping: Most items are shipped within 24-48 hours. All orders are shipped ground unless other arrangements have been made and approved with Aquatic Ponds. We do not ship to P.O. Boxes as UPS does not deliver to P.O. Boxes. We do not ship to FPO/APO. Most orders are shipped UPS or by Fedex unless item does not meet their guidelines. Shipping rates including free shipping when it applies are to the lower 48 states. Sorry, we no longer ship to Hawaii, Alaska, PR or Canada. If a package is returned to us due to a non delivery, you are held responsible for any extra shipping charges incurred. We do not give money back on your purchase due to shipping errors on behalf of the purchaser. If an order is refused you will be liable for the cost of product and any and all shipping charges. If Aquatic Ponds allows for the return of the merchandise a 20% restocking fee will occur plus shipping charges and any other fees associated with the return.

Shipping by Freight Carrier: Items that are over 150 lbs. (example: pond liner) must be shipped by a Freight Carrier. The Freight Carrier will go as close to your driveway as possible for the delivery. These trucks are very long (around 45') and not only will they need to be able to get to the delivery point but will also need to be able to turn around. The trucking company is not responsible for unloading your item or items. Someone must be present at time of delivery. We suggest a minimum of 2 to 3 people depending on the weight of the item. If you are unsure of how much an item weighs please email us so we may give you an approximate weight. We cannot guarantee delivery times yet we will help coordinate a delivery time. We will not be held responsible for any charges relating to labor stand by charges, equipment rentals, time delay or any other charges that may be incurred with the delivery. We will not be held responsible for off loading your items or additional delivery charges due to inaccessibility to the ship to address. Any questions please email or call us. The Freight Carrier will need your phone number so they can contact you for delivery day.
Sales Tax: Pennsylvania Residents must add: 6% Sales Tax on total. If however you are a business in the State of Pennsylvania and will be reselling products you will be able to send the appropriate documentation with your Sales Tax Id #. Sales Tax Id # will need to be confirmed by Aquatic Ponds before any product is purchased. Once Sales Tax Id # is confirmed the sales tax can be waived. We do not collect tax from any other states.
Insurance: All items will be insured and have a tracking number if shipped by UPS or Fedex. Tracking numbers will only be provided to customers that leave their email address and that have asked for a tracking #. Upon receipt of package you must inspect all items for damage and to make sure you received all the items you ordered are correct. If item is incorrect or damaged due to shipping. Aquatic Ponds and carrier must be notified within 5 days of the package that has been delivered. You are required to retain all original packaging, material and item or items in unused condition to be inspected by the carrier for a possible claim. If damage occurs from a common carrier you should have the damage written on the bill of lading. Once you have signed the bill of lading you are agreeing that there is no physical damage. Please inspect shipment before signing any bill of lading. Aquatic Ponds cannot be liable once you receive and sign for the merchandise.
Returns: On occasion if approved by Aquatic Ponds an order may be returned less a 20% restocking fee and actual shipping charges. Otherwise all sales are final. Freight will not be reimbursed. We value each and every customer however we do not accept returns on used equipment as we do not sell used equipment. If and only if Aquatic Ponds has approved a product being returned the item must have RA # (Return Authorization Number). Do not send product back without one. We reserve the right to refuse any such returns. Buyer is responsible for shipping charges when returning a product. RA # does not guarantee a refund. All returns are subject to inspection. Items such as special orders, pond liners, underlay, tubing, liquids, fish food, plant food, replacement Parts and UV Clarifiers cannot be returned for any reason. If you received and item with free shipping and you are approved to send your return the 20% restocking fee will be off the product minus the actual shipping charges. Remember even though we sell most of our products with Free Shipping the shipping prices are included in our Free Shipping Price. And even though we market our prices with Free Shipping there is no actual Free Shipping to send the product and once the product has been shipped the cost of shipping cannot be and will not be reimbursed. We are not responsible for illustrational & typographical errors. We will do our best to try to have accurate illustrations and non typographical errors. We will not take back used products as we do not sell used products.
Warranty: All items are new with full manufacturer's warranty unless otherwise stated. Manufacturer handles all warranty-related issues. Buyer pays all shipping costs to return the warranty item to the manufacturer. Aquatic Ponds is not responsible for warranty claims. If Aquatic Ponds does handle a warranty issue the product must be returned first before another one is sent out.
Warranty on Pond Pumps: Do not cut the cord or it voids the warranty. The pump must not have been hard wired. The pump must have been submerged at all times with no water line mark on the pump. Low water lines void warranty. If your pump was tripping the gfi please check more then one outlet. Once the pump is returned and tested and if found not to be defective there will be a shipping charge to send the pump back to you. You will also want to check your pump for debris clogging up the impeller.
Privacy: When ever you click on any "add to cart” or "view cart" button your computer is automatically connected to a secure server which uses the "SSL or Secure Server Layer encryption method to protect your privacy. No customer information will ever be sold or distributed to another party. Guaranteed.
Liability: NOTICE: We recommend you follow all manufactures instructions and use a GFCI (Ground Fault Circuit Interrupter) outlet when using electrical products near or in the water for your safety and the safety of others. Aquatic Ponds assumes no liability for use or misuse of any products sold by Aquatic Ponds or its suppliers.
Availability: From time to time we may run out of an item. Sometimes extreme circumstances that we have no control over may make an item unavailable. We do our best to keep the products we offer in stock. If the item is unavailable you may wait for it to come in or cancel the order if we cannot ship out the product within 10 days of receipt. We reserve the right to withdraw any item with out notice. We do our best to keep plenty of inventory and 99.5% of the time the products we offer are in stock and ready to ship. Pricing and availability are subject to change without notice. We reserve the right to limit quantities and to cancel any order.
