General:
When an order is placed it indicates the acceptance of the terms and conditions stated below. We reserve the right to change the terms and conditions at any time.

Shipping:

Most items are shipped within 24-48 hours. Free shipping when it applies are to the lower 48 states. Sorry, we no longer ship to Hawaii, Alaska, PR or Canada. If a package is returned to us due to a non-delivery, you are held responsible for any extra shipping charges incurred.  If an order is refused you will be liable for the cost of product and any and all shipping charges.


Shipping by Freight Carrier:

Items that are over 150 lbs. or that are dimensionally too big to go by ground must be shipped by a Freight Carrier. The Freight Carrier will go as close to your driveway as possible for the delivery. The trucking company is not responsible for unloading your items. Someone must be present at time of delivery. We suggest a minimum of 2 to 3 people depending on the weight of the item. The carrier will contact you to coordinate a delivery time. We will not be held responsible for any charges relating to labor stand by charges, equipment rentals, time delay or any other charges that may be incurred with the delivery. We will not be held responsible for off-loading your items or additional delivery charges due to inaccessibility to the ship to address. Our Free Shipping does not include a lift gate. If a lift gate is needed you may ask the freight carrier for a price to have a lift gate at the time of delivery. The Freight Company will end up billing you for the lift gate. Usually items can be taken off the pallet without a lift gate service. When delivery is made inspect all merchandise and check the number of packages you received with the bill of lading before signing. Note any damages or shortages directly on the bill of lading and notify us within 24 hours. Once you have signed the bill of lading you are agreeing that there is no physical damage. We suggest putting "Subject to Inspection" on the bill of lading. Aquatic Ponds LLC cannot be liable once you receive and sign for the merchandise.


Warranty and Returns:
Someone from Aquatic Ponds LLC will assist you for returns of most products purchased from us.
Aquatic Ponds LLC will only accept authorized returns. An RA (Return Authorization) number must accompany any return, and be clearly marked on the outer box being returned.

Defective Products:
The manufacturers below will service their own warranties. However Aquatic Ponds LLC would still like to know if you have a warranty issue. So please call us first at 215-525-1440. We may be able to troubleshoot the problem for you.

Aquatic Ponds LLC will process the product warranty (excluding the manufacturers listed above) at no additional cost to the customer other than the cost of returning the item to us.

Defective items are subject to inspection. Customers will be charged for replacement pumps if the original pump is not warrantable, such as a power cord that has been cut or damaged. The pump must not have been hard wired.

If a product is defective within 30 Days of purchase unless it is one of the above manufactures, Aquatic Ponds LLC will ship a replacement and prepaid return label so that the defective product can be returned at our cost. After 30 Days it is considered a warranty issue and must be shipped back by the customer.

Customers will be charged if the defective product is not returned within 15 days of replacement.

If a product is returned under the warranty and found defective we will send a replacement at no charge. Items that are not found defective, will be returned at the customer's expense.

All products are under warranty from original ship date only and do not renew with replacements.

If for some reason we take back a product after 30 days then there would be a 20% restock fee after subtracting the actual shipping fees that it took to ship if it was a Free Shipping item. Shipping charges are not refundable.

Returning New Products: (We cannot take back a used product as we do not sell used products)!
Aquatic Ponds LLC will accept new products within 30 days of date of the shipping date. Please ship the item back with the original packaging enclosed within a separate box to minimize package damage. All returns must have an RA#. Please call 215-525-1440. Items such as pond liner, underlay, tubing (tubing, liner and underlay are cut to the size ordered), Performance ProPumps, Brass Baron and Proeco Fountain Spray Ring or custom orders are items that cannot be returned for any reason. Matala products could have a 15% restock fee.

Products purchased that had free shipping, will have the shipping amount deducted from the refund. Because we market our prices with Free Shipping there is no actual Free Shipping to send the product and once the product has been shipped the cost of shipping cannot be and will not be reimbursed. If for some reason an item is being returned that was shipped by freight the original freight charge including any fees associated with the shipment will be deducted.

For any product returned that was a Free Shipping offer over $75 and with the amount going under $75 actual shipping charges of the entire order would be deducted as if it was not part of the Free Shipping offer. In other words you would need to pay for the actual shipping cost that it took to send the products to you.

If you are returning a product and had paid the Flat Rate Shipping of $6.95 you will be responsible for the actual shipping price that it cost to send you the product. In almost all cases the $6.95 will not cover the entire shipping cost that the product actually cost to send to you. Example if a product had cost $20.00 and had a flat shipping rate of $6.95 and you end up returning it the actual shipping cost will be deducted from the $26.95.

Freight cost and arrangements are the responsibility of the customer. Original freight costs are non-refundable. It is recommended to have tracking and Insurance for your return

All returned products are subject to inspection prior to any credit or refund given. All products returned as new, but have been in service will be considered a "Used Product" and 20% restocking fee will apply. Pond Filters and Pond Vacuums are subject to a 25% restocking fee. If a product is returned that is not sellable whatsoever the product will be destroyed and there will be no refund.

 Whenever you click on any "add to cart” or "view cart" button your computer is automatically connected to a secure server which uses the "SSL or Secure Server Layer encryption method to protect your privacy. No customer information will ever be sold or distributed to another party. Guaranteed.

Liability Notice:
We recommend you follow all manufactures instructions and use a GFCI (Ground Fault Circuit Interrupter) outlet when using electrical products near or in the water for your safety and the safety of others. Aquatic Ponds LLC assumes no liability for use or misuse of any products sold by Aquatic Ponds or its suppliers.
